Failure of government to follow the Surpreme Law of the Land

We are experiencing the fall of our government as we know it. When legislators take the attitude that they know better our needs as a people,as individuals and communities then the representative government becomes defunct. When the elected turn a blind eye and a deaf ear to the will of the majority to advance their own personal agendas then at that moment I would ask the question; Are we bound to follow the leadership of that government? You educate yourself and decide.

I do not ask that question lightly. I am aware that this administration takes a dim view of anyone that would have the audacity to question their leadership abilities and motives. I am also aware of the disdain that they have for the populace in general. Lies and deceit are the standard of this president and his staff. They think nothing of the truth. The truth is an inconvenience that need not be addressed. The mockery that is made of any group that takes a stand is nothing short of a revelation of their wicked prideful hearts.

So what is in violation according the Constitution and Bill of Rights?
Freedom of speech would be a start. To be mocked by the speaker of the house is evidence of either the lack of understanding that people have a right to ban together and speak out or (I believe this is the case) contempt for the Bill of Rights and its precepts. They demand respect but do not believe it is a two way street.
Article the third [Amendment I]
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

Then what about the right to peaceably assemble? Would not the reactions of leaders show an attitude that is prejudice. When sodomites can march on Washington and are considered a kind of heroes and stand in our capital perpetrating vile acts and nothing is said. But let a couple million Tea Party protesters show and we get a reaction of hate full of venom. Why would that be? Because we stand in the way of their brand of liberty. Freedom for them to change our form of government a socialism.

Article the third [Amendment I]

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

People have been allowed to redress grievances many times during my life. The civil rights movement is one example. Now we have the Tea Party growing by leaps and bounds and the undercurrent is that socialist hope and change is NOT what the people want. They want less government not more and we want life, liberty, and the pursuit of happiness. Not oppression, dictators, and heavy taxes funding things we don't support or believe in.

Article the twelfth [Amendment X]
The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

There is no authority under the Constitution for these people to assume the powers that have been taken. Nor can the legally force people to associate in their healthcare or any other socialistic endeavor. Power is to the people not the elite. The Founding Fathers set in place safeguards that the people have the right to resist such changes that are not Constitutional and never to allow the establishment of an elite/ruling legislature or judiciary.

Section 9 No Title of Nobility shall be granted by the United States: And no Person holding any Office of Profit or Trust under them, shall, without the Consent of the Congress, accept of any present, Emolument, Office, or Title, of any kind whatever, from any King, Prince, or foreign State.

Health care was bought through the Senate.....

Note I said the so called healthcare reform was BOUGHT(it wasn't a typo) through the senate by Harry Reid D-NV and his crooked minions. sen Ben Nelson D-NE I am sure was bought off just as was Mary Landreau D-LA and others. With overwhelming citizen opposition the socialist/marxist bill passed today. To add hurt to injury the vote buying was also paid for by the Tax Payer.
The Founding Fathers would be calling for revolution and a dismantling of this government.The Constitution has once again been ignored and the governed have been trampled upon.

I am not sure what all the ramifications are and believe we cannot know all due to the secret underhanded way it was constructed and passed or how much leeway it gave to bureaucracy. Where is the promised transparency? Only EVIL has to hide in the darkness and only Truth can be bold and open. It is a sad day in this nation. The Framers of the Constitution intended that bills before the congress would be long drawn out debates. The complicated process put in place was to allow time for the dirty little secrets to come to light and be removed. Time for the people to react and fight. The reason for this push to vote before Christmas was to give the crooked ones an excuse before they went home to face the people. We should not let them rest the whole of Christmas vacation. Shame on them and shame on us that sat by and did not stand up.

Public Money for Private Business.

We have been hearing a lot about private business receiving public money,your money, and government takeover of private businesses. First let me say that I find nowhere in the Constitution that the federal government has the authority to either authorize funds, tax money, to be used for private business. Nowhere. Further more I find nowhere does the government have authority to interfere with free market enterprise or take over any private business. They do have limited federal authority to prosecute criminal activity by businesses and they do have some authority to prosecute individual criminal activity. I say some because the states have more jurisdiction and power than the federal government.

Now we do not see prosecutions because mismanagement is not a criminal offense. If a company like General Motors cannot operate at a profit the free market dictates that they go out of business. If a company does not produce a product that the people want or need then the result is company closure. It really is that simple. Propping up companies simply is not constitutional and cannot legally be practiced.

When government starts to meddle in private affairs it only leads to chaos and a unproductive environment. Man was created to produce and reap fruit from his labor. Limited Powers of the Federal Government

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

Our founding Fathers intended that the majority of power remain with the states and that the federal government be limited.

Why would they want to address a limited federal bureaucracy? Why would a fledgling government even consider limiting it's own body of power? The foresight and wisdom of these men is nothing short of miraculous. They knew the hearts of men, given the chance, would work for their own interests. They wanted to keep the seat of power near the people where the constituency would have an arms length control of the representatives. The law making would be literally in the neighborhood where the people could keep an eye on the process.

What we have today is a powerful seat of government distant from the majority of the people passing laws and meddling in the affairs of people not constitutionally granted. We have recently seen examples of the representation ignoring the will of people and acting in their own personal interests setting themselves up to gain position and monetarily.

Some examples of unconstitutional actions of late are the so called "stimulus" which neither stimulated anything for the benefit of the people but was a direct violation of constitutional law.
Health care is not in the realm of federal powers and the taxation without the consent of the people certainly is not. Department of Education was intended to be left to the local school boards, not a national bureaucracy.
Most social programs and giveaways have no constitutional basis IE: "Cash for Clunkers". The national emergency of swine flu H1N1 was not and is not an emergency at all. Lies and deceit are definitely not constitutional.

What measures must the people, you and I, take to regain control and put a stop to the lunacy?
Number One, first and foremost is self-education. We cannot force a return to the Constitution without knowledge of the content but also of the intent of the Formers of this document. We must know the men behind the document. This blog will assist you with that. Together we can learn of them.

Number Two We must debunk the outright lies and misconceptions. One example that comes to mind is "Separation of Church and state". Not only is that statement not part of the constitution it is not part of the intention. Freedom of Worship is guaranteed. I will address where the perpetrators of this lie got the idea and educate you as to what Thomas Jefferson actually said, to whom he was talking, and why. You will be surprised and disgusted.

Number Three we must investigate candidates that will stand with the constitution no matter what and remove by election the President, Senators,Congress those that degrade and ignore that document.
